
196. Acting Chief Justice.
1[96. Acting Chief Justice.-At any time when-
(a) the office of Chief Justice of a High Court is vacant, or
(b) the Chief Justice of a High Court is absent or is unable to perform the functions of his office due to any other cause, the President shall appoint 1[one of the other Judges of the High Court, or may request one of the Judges of the Supreme Court], to act as Chief Justice.

1. Item 38 of the schedule to P.O. No. 14 of 1985, reintroduced the said words (w.e.f. March 2, 1985), in place of the words “one of the Judges of the High Court who have not previously held the office of Chief Justice of the High Court otherwise than under this Article” which were substituted by section 10 of the Constitution (Fifth Amendment) Act 1976). (62 of 1976. (w.e.f. September 13, 1976). The reintroduced words were a part of Art. 198, as adopted in 1973.
