Lambardar is not the holder of an “office of profit in the service of Pakistan” within the meaning of paragraph 4(1)(C), Part II of the Fourth Schedule to the Consntitution (1956) and in not disqualified to become a Member of the Assembly.

The office of a Lambardar is not covered by the definition of “service of Pakistan” as given in Article 218 of the Constitution (1956).

An analysis of Articles 179, 180 and 181 showed that the Constitution did not intend to include a Lambardar in the service of Pakistan.
